Rosedale Workers’ Compensation Lawyer

If you’ve suffered a workplace injury in Rosedale, seeking guidance from a Workers’ Compensation Lawyer is essential. Without legal representation, nearly 74% of injured workers risk losing their benefits or encountering complications with insurers.

Although employers are required to carry workers’ compensation insurance, the final decision on benefits rests with the insurer and the Maryland Workers’ Compensation Commission. An experienced attorney can help you navigate the claims process and secure the compensation you’re entitled to.

Mr. Shultz and his legal team are amazing! I'm aware they have other specialties, but I recommend them for any type of Worker's Comp case that you have, any day of the week! I had the pleasure of dealing with Ms. Kristie, who made sure I was set up for appointments and had knowledge of the days and times, and that all paperwork was straight. After it was all said and done, it took all of one week for a decision to come back and a few days until I could come pickup my check. Shultz legal team made this process so easy for me and I am forever appreciative. This is the team for you, hands down!

Amazing group! The entire team at Schultz Legal really considers the client when taking on a case. I wasn’t very knowledgeable in the in the realm of Workers Comp at the beginning of my case, but Jason, Lindsey(who is an absolute rockstar), and the rest of the team really worked to ensure that I could understand the process and that I was kept up to date on everything it involved. They were professional, informative, attentive, and overall a very pleasant group to work with throughout the whole process. I’m lucky to have had Jason and his team as legal representation in this matter. I would highly recommend Schultz Legal to anyone who happens to find themselves in a situation involving WC.Thank you!

The experience with Shultz legal was ok I didn't no to much about their firm my case was transferred to him from partner Mallon. But far as what I experienced in the time dealing with them I say things moved a little slow but it worked out. Ok now I still believe for what it's worth I didn't get the fair share for my pain but I can deal with that because it has been so long in I have to keep working for my family it never was about a lawsuit in money but anyway I just want to thank Shultz and Mallon in all their assistants team members for playing their part in my life doing my difficult situations I am humbled.

What Injuries are Covered by Workers’ Compensation Insurance?

Not every workplace injury in Rosedale qualifies for workers’ compensation benefits. The Maryland Workers’ Compensation Commission requires that injuries be classified as “accidental personal injuries arising out of and in the course of employment,” making the details of each case critical.

To be eligible, injuries must be directly related to job duties, occur during work hours, and result from workplace conditions. Injuries sustained outside of work responsibilities or due to intentional actions may not be covered. While gradual injuries, such as repetitive stress injuries, may qualify, they often undergo stricter evaluation.

Maryland also acknowledges certain occupational diseases caused by prolonged exposure to hazardous workplace substances, such as toxic fumes or chemicals. Health conditions like respiratory or skin diseases may be covered if directly linked to workplace exposure.

Since each case is thoroughly reviewed, working with a workers’ compensation attorney can help strengthen your claim and improve your chances of receiving benefits.

A Closer Look at Maryland Workers’ Compensation Laws

The Maryland Workers’ Compensation Commission plays a central role in managing and regulating workers’ compensation claims within the state. Its duties encompass:

  • Defining what constitutes a payable injury
  • Reviewing cases where injuries occurred during employment
  • Investigating accidents caused by third-party negligence during work hours
  • Determining if illnesses arising from workplace injuries qualify for workers’ compensation benefits

How To File For Workers’ Compensation in Rosedale

If you’re injured at work in Rosedale, notify your employer within ten days and complete an accident report to ensure proper documentation. For work-related illnesses caused by prolonged exposure to hazardous materials, Maryland law provides up to one year to report the condition.

After informing your employer, they should initiate the claims process with their insurance provider. If medical attention is needed, seek treatment immediately to protect both your health and your claim.

Additionally, you must file a claim with the Maryland Workers’ Compensation Commission within 60 days of the injury. The insurer then has 21 days to evaluate your claim and determine your eligibility for benefits.

Why Your Workers Comp Claim Might Be Denied

Workers’ compensation claims can be denied for various reasons, leaving injured employees struggling to cover medical expenses and lost wages. One common cause of denial is an incomplete or incorrect application—small errors or missing details can result in delays or outright rejections, underscoring the importance of accurate paperwork.

The specifics of the injury also play a role in claim approval. Injuries that are difficult to directly associate with work duties or occur outside normal job responsibilities often face higher scrutiny. If there is uncertainty about whether the injury happened “in the course of employment,” the claim may be denied.

Having an experienced workers’ compensation attorney on your side can significantly improve your chances of success. A lawyer can help compile necessary documentation, organize medical records, and clearly establish the link between your injury and your job. With professional legal guidance, you can minimize errors, strengthen your claim, and improve the likelihood of receiving the benefits you deserve, particularly in the event of disputes with insurers.

How to Appeal a Workers’ Compensation Denial in Rosedale

If your workers’ compensation claim is denied, navigating the appeals process can be complex. Seeking guidance from an experienced attorney can significantly improve your chances of success. The first step in appealing a denial is submitting an issues form to the Maryland Workers’ Compensation Commission (MWCC). This request prompts a commissioner to review your case and determine whether you qualify for benefits.

If you disagree with the commissioner’s ruling, you have 15 days to request a rehearing, though these requests are not always granted. An attorney can help strengthen your case by addressing weaknesses, clarifying key details, and providing additional supporting evidence to enhance your appeal.

If a rehearing is denied, you still have legal options. You can escalate the appeal to the Maryland Circuit Court, where a judge will conduct an independent review of your claim. If necessary, you can continue your appeal to the Maryland Court of Special Appeals. Though the process can be lengthy and challenging, having a knowledgeable lawyer by your side can improve your chances of securing the benefits you deserve.

What Benefits are Available to Injured Workers?

There are several different types of benefits available to injured workers. These include:

  • Temporary Partial Disability Benefits
  • Permanent Total Disability Benefits
  • Permanent Partial Disability Benefits
  • Medical/Hospitalization Benefits
  • Wage Reimbursement Benefits
  • Vocational Rehabilitation Benefits
