Mr. Shultz and his legal team are amazing! I'm aware they have other specialties, but I recommend them for any type of Worker's Comp case that you have, any day of the week! I had the pleasure of dealing with Ms. Kristie, who made sure I was set up for appointments and had knowledge of the days and times, and that all paperwork was straight. After it was all said and done, it took all of one week for a decision to come back and a few days until I could come pickup my check. Shultz legal team made this process so easy for me and I am forever appreciative. This is the team for you, hands down!

Amazing group! The entire team at Schultz Legal really considers the client when taking on a case. I wasn’t very knowledgeable in the in the realm of Workers Comp at the beginning of my case, but Jason, Lindsey(who is an absolute rockstar), and the rest of the team really worked to ensure that I could understand the process and that I was kept up to date on everything it involved. They were professional, informative, attentive, and overall a very pleasant group to work with throughout the whole process. I’m lucky to have had Jason and his team as legal representation in this matter. I would highly recommend Schultz Legal to anyone who happens to find themselves in a situation involving WC.Thank you!

The experience with Shultz legal was ok I didn't no to much about their firm my case was transferred to him from partner Mallon. But far as what I experienced in the time dealing with them I say things moved a little slow but it worked out. Ok now I still believe for what it's worth I didn't get the fair share for my pain but I can deal with that because it has been so long in I have to keep working for my family it never was about a lawsuit in money but anyway I just want to thank Shultz and Mallon in all their assistants team members for playing their part in my life doing my difficult situations I am humbled.

What Injuries are Covered by Workers’ Compensation Insurance?

In Maryland, not all work-related injuries qualify for workers’ compensation benefits, as defined by the Maryland Workers’ Compensation Commission. To be eligible, the injury must result from an “accidental personal injury arising out of and in the course of employment.” This stipulation means that simply being injured at work doesn’t automatically guarantee coverage under workers’ comp; the circumstances of the injury matter significantly.

For example, injuries must be directly related to work duties, occur during working hours, and arise from tasks or conditions tied to employment. Incidents that occur outside the scope of job responsibilities or due to intentional actions may not be eligible. Moreover, injuries that develop gradually over time, such as repetitive strain injuries, may face more scrutiny but could still be considered for compensation if directly related to work activities.

Maryland also recognizes certain occupational diseases under workers’ compensation coverage. These are medical conditions that develop due to prolonged exposure to hazardous materials or substances within the work environment, such as chemical exposure, asbestos, or toxic fumes. Examples include respiratory issues, skin conditions, or chronic illnesses resulting from exposure to harmful agents on the job. To qualify, these occupational diseases must be directly tied to workplace conditions or exposure levels that exceed what would be typical in other environments.

In all cases, the Maryland Workers’ Compensation Commission closely reviews each claim to determine eligibility based on the nature of the injury, the circumstances surrounding it, and the connection to the employment setting. Consulting a workers’ compensation attorney can be beneficial to navigate these nuances and strengthen a claim.

A Closer Look at Maryland Workers’ Compensation Laws

The Maryland Workers’ Compensation Commission plays a central role in managing and regulating workers’ compensation claims within the state. Its duties encompass:

  • Defining what constitutes a payable injury
  • Reviewing cases where injuries occurred during employment
  • Investigating accidents caused by third-party negligence during work hours
  • Determining if illnesses arising from workplace injuries qualify for workers’ compensation benefits

How To File For Workers’ Compensation in Reisterstown

If you’re injured on the job in Reisterstown, it’s essential to notify your employer within ten days of the incident. Complete any accident report they provide to officially document the event and establish a record of the injury. For occupational illnesses—such as medical conditions or diseases arising from long-term exposure to harmful substances at work—you have up to one year to report the issue in Maryland.

Once you notify your employer, they should begin the claims process with their insurance provider. If your injury requires immediate medical attention, don’t delay; consult a physician promptly and start necessary treatment. Your health and recovery should be your first priority.

Following this, you will need to file a claim with the Maryland Workers’ Compensation Commission within 60 days of the incident. This step is crucial in ensuring your claim is officially registered and processed. Once your claim is filed, the insurer has 21 days to evaluate and make a decision on whether to approve or deny your request for benefits.

Why Your Workers Comp Claim Might Be Denied

Workers’ compensation claims can be denied for various reasons, leaving injured employees without the benefits they need to cover medical costs and lost wages. Common causes for denial include incomplete or inaccurate applications, which can lead to processing delays or outright rejections. Even small errors or missing documentation can affect your eligibility, underscoring the importance of a well-prepared application.

Additionally, the nature of the injury itself may impact approval. For instance, injuries that are difficult to link directly to work activities or injuries sustained outside typical job duties may face additional scrutiny. Claims are more likely to be denied if there is any question regarding whether the injury genuinely occurred “in the course of employment.”

Partnering with an experienced workers’ comp attorney can make a significant difference in the approval process. Attorneys can guide you in gathering relevant documentation, organizing medical records, and ensuring that your application clearly demonstrates how the injury relates to your work. Their expertise can help avoid common pitfalls, reduce the chances of claim denial, and improve the likelihood of a successful outcome, especially if any disputes with the insurer arise.

How to Appeal a Workers’ Compensation Denial in Reisterstown

If your workers’ compensation claim is denied, the appeals process can be challenging, making it wise to consult an experienced attorney who can guide you through each step. To begin the appeal, you must submit an issues form to the Maryland Workers’ Compensation Commission (MWCC). This form initiates a review of your case, and a commissioner will evaluate your claim to determine whether benefits are warranted.

If you disagree with the commissioner’s decision, you have 15 days to request a rehearing, though rehearings are often difficult to secure. An attorney can help strengthen your request by identifying and addressing areas in your case that need clarification or additional evidence, increasing your chances of a favorable outcome.

Should the rehearing request be denied, you still have options. You can escalate your case to the Maryland Circuit Court, where a judge will conduct an independent review of your claim. If necessary, you can further appeal to the Maryland Court of Special Appeals. This multi-step appeals process can be complex and lengthy, but with skilled legal support, you’ll have a better chance of securing the benefits you’re entitled to.
