The experience with Shultz legal was ok I didn't no to much about their firm my case was transferred to him from partner Mallon. But far as what I experienced in the time dealing with them I say things moved a little slow but it worked out. Ok now I still believe for what it's worth I didn't get the fair share for my pain but I can deal with that because it has been so long in I have to keep working for my family it never was about a lawsuit in money but anyway I just want to thank Shultz and Mallon in all their assistants team members for playing their part in my life doing my difficult situations I am humbled.

When Do I Have A Claim To Wrongful Death In Baltimore?

In Baltimore, a wrongful death claim can be pursued when a person’s death is caused by another’s negligence or intentional act. This typically involves situations where the deceased could have filed a personal injury lawsuit had they survived. Close family members, such as a spouse, parents, or children, are generally eligible to file the claim.

The claim seeks to compensate for the emotional and financial impact of the loss, including mental anguish, loss of companionship, and financial support. It’s important for those affected to consult a legal professional to understand their rights and the specifics of their case in the context of Maryland laws.

Here are some common situations that might lead to a wrongful death claim:

Medical Malpractice: Errors in diagnosis, treatment, surgery, or medication that lead to death.
Vehicle Accidents: Fatalities resulting from negligent driving in car, truck, motorcycle, or pedestrian accidents.
Workplace Accidents: Deaths occurring due to unsafe work environments or practices, particularly in high-risk industries.
Criminal Actions: Deaths resulting from criminal activities, including violent crimes.
Product Liability: Fatal injuries caused by defective or unsafe products.
Premises Liability: Deaths due to hazardous conditions on someone else’s property, such as slip and fall accidents.
Nursing Home Abuse or Neglect: Fatalities arising from improper care or abuse in elder care facilities.

What Is The Average Settlement From A Wrongful Death Case in Maryland?

Factors influencing settlement amounts include the circumstances of the death, the decedent’s age and earning capacity, the impact on surviving family members, and the degree of negligence involved. Settlements can range from modest amounts to several million dollars.

In Maryland, economic damages in wrongful death cases, which cover tangible losses like lost wages and medical expenses, are not capped. However, non-economic damages, which include pain and suffering, loss of companionship, and emotional distress, are subject to caps. As of 2023, the cap for non-economic damages in personal injury cases is $935,000, and for wrongful death cases with two or more survivors, the cap is $2,262,500. These caps are adjusted annually for inflation.

What Is The Statute Of Limitations For A Wrongful Death Case In Maryland?

In Maryland, the statute of limitations for filing a wrongful death lawsuit is generally three years from the date of the deceased person’s death. However, for cases involving occupational diseases linked to exposure to toxic substances in the workplace, the statute of limitations extends to either ten years from the date of death or three years from the date when the cause of death was discovered, whichever is shorter.
